These Terms and Conditions ("T&Cs") govern your use of our website located at www.gasstationguitars.com ("Website") and form an agreement between you, the user of the Website and us, Gas Station Guitars Ltd ("GSG").

For that reason these T&Cs are important and you should ensure that you read them carefully and contact us with any questions before you use the Website. You can contact us at gasstationguitars@gmail.com If you do not agree to the T&Cs, please do not use the Website.

1. GSG Information

   1. This Website is owned and managed by Gas Station Guitars Ltd. We are a company registered in England and Wales. Our company registration number is 10433407. The quickest way to contact us is via email.

   2. Unless stated otherwise, we use the terms ‘GSG’, ‘Gas Station Guitars’, ‘we’ and ‘us’ in these T&Cs and throughout the Website to mean Gas Station Guitars Ltd.​

2. Agreement

   1. By using the Website you acknowledge and agree that:​

      1. You have had sufficient chance to read and understand the T&Cs and you agree to be bound by them.

      2. A breach by you of these T&Cs may lead to legal proceedings or other appropriate action.

   2. GSG reserve the right to amend the T&Cs at their complete discretion from time to time. You agree to review the T&Cs from time to time. If you use the Website after GSG have amended the T&Cs, you are agreeing to be bound by the amended T&Cs. If you do not agree to be bound by the T&Cs subsequent to future amendments you should discontinue your use of the Website.

3. Use of Website

   1. You may access and use the Website in the normal manner for lawful purposes only.

   2. You may use, download or print Website content for your sole personal use only.

   3. Other than for personal use, you may not:

      1. copy, reproduce, use or otherwise deal with any content on the Website;

      2. modify, distribute or re-post any content on the Website for any purpose;

      3. reproduce, crawl, frame, link to or deep-link into this Website on or from any other website;

      4. use the content of the Website for any commercial exploitation whatsoever.

4. Accessing Website from Outside the UK

   1. GSG is a UK based business governed by the law of England and Wales. All transactions entered into with GSG via this Website or otherwise are governed by the laws of England and Wales.

   2. GSG may accept orders for delivery to locations outside of the UK at their total discretion, with consideration given to any matter GSG consider relevant including but not limited to, customs, legal, regulatory, safety and practical considerations.

   3. Persons who choose to access this Website from outside the UK are solely responsible for compliance with local laws, including but not limited to any applicable customs duties.

5. Payment

   1. All payments made on the Website are by way of an internet secure payment system sourced from a third party. You must refer to the T&Cs and conditions of the third party for particulars regarding the transaction.

   2. You will be automatically provided with a receipt upon purchase.

   3. Paypal no longer refund the seller’s fees for cancelled orders. Any orders made and then cancelled will be fully refunded (inc. your shipping) but minus the Paypal fees charged to us.

6. Privacy

   1. This Privacy Policy applies to all personal information collected by GSG via the Website.

   2. Your privacy is very important to us. For that reason, please read the following details carefully and get in contact with us if you have any questions. You can contact us at gasstationguitars@gmail.com.

   3. GSG may collect personal information from you in the course of your use of the Website if you input any personal information into the Website.

   4. The purpose for which we collect personal information is to provide you with the best service experience possible on the Website and for practical reasons such as delivery of your purchased items.

   5. You may receive emails from GSG relating to new stock, special offers, other information about GSG we think might interest you. You can opt out of receiving email from GSG by emailing ‘Unsubscribe’ to gasstationguitars@gmail.com at any time.

   6. GSG may retain your personal information for a period up to 7 years to comply with legislative requirements with respect to record keeping.

   7. Where GSG are no longer required or authorised by law to retain your personal information it will be destroyed or permanently de-identified.

   8. GSG will use the personal information you provide to provide you with the service you have requested and will not disclose any of your personal information to a third party except where:

      1. You consent to the disclosure;

      2. It is necessary to provide you with the services you have requested, as determined by GSG (e.g. to a courier service);

      3. A Court, law or regulation requires that the personal information be disclosed, including with respect to the investigation or reporting of suspected unlawful activity;

      4. The GSG T&Cs provide that the personal information will be disclosed;

      5. Disclosure of your personal information is necessary to prevent or reduce a serious risk to health or safety, as determined by GSG.

      6. GSG may provide statistical information about the services and users of the Website to third parties, however all personally identifiable information will be removed.

   9. Section 7 of the Data Protection Act 1998 allows you to get access to, and correct, the personal information we hold about you in certain circumstances. If you would like to obtain such access, please contact us on the details set out above.

   10. We have processes in place to ensure the security of your personal information, including encryption of all data when it is transferred to our service providers and limitations on access to personal information within our organisation.

   11. The Website may contain links to other Websites that are not controlled or owned by GSG. GSG provides no commitment, warranty or guarantee with respect to the security and privacy practices of such Websites.

7. Intellectual Property Rights

   1. All rights, including copyright and other intellectual property rights, in and to this website are owned or licensed to GSG.

   2. You acknowledge that any use of any part of the Website will be an infringement of GSG intellectual property rights.

8. Liability

   1. To the full extent permitted by law, we exclude all liability for any direct, indirect, incidental or consequential damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, use of, inability to access or reliance on the Website or its content.

   2. GSG does not guarantee the accuracy of information, or anything else on the Website.

   3. To the full extent permitted by law, we exclude all representations, warranties or T&Cs (whether express or implied) other than those expressly set out in these T&Cs.

   4. GSG uses reasonable efforts to ensure that this Website is free from viruses and other malicious or harmful content. However, we cannot guarantee that your use of this Website (including any content on it or any website accessible from it) will not cause damage to your computer or other device. It is your responsibility to ensure that you have the right equipment (including anti-virus software) to use the Website safely and to screen out anything that may damage or harm your computer or other device. Except where required by applicable law, GSG shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful content that they access from or via the Website.

   5. If you believe your computer, laptop, mobile phone or any other device used to access this Website, has been infected by content downloaded from this Website, either directly or indirectly, please contact us immediately.

9. Terms of Sale – Product Descriptions

   1. We have taken reasonable steps to try and ensure that all product information, including prices quotes and product descriptions are accurate. Nevertheless, when ordering products from the Website please note the following:

      1. Orders will only be accepted if there are no material errors in the description of the product or the price advertised on the Website;

      2. All prices are displayed in pounds Sterling.

      3. Any weights, dimensions, etc, detailed on the Website are approximate only;

      4. We try to display the colours of our products accurately on the Website, however the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery;

      5. All items are subject to availability. We will inform you as soon as possible if the product(s) you have ordered are not available and we may offer alternative product(s) of equal or higher quality and value at our total discretion.

      6. The cost of delivery will be shown at the point of order but we reserve the right to change this in circumstances where the charge is incorrect.

10. Terms of Sale – Acceptance of Your Order

    1. Completion of the checkout process on the Website does not constitute our acceptance of your order. Our acceptance of your order occurs at the time we dispatch the product(s) to you.

    2. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, placing an order on this Website places you (the consumer) under an obligation to pay. The specific moment that this becomes applicable is when you (the consumer) click on the "Pay Now" button on the order confirmation page. If you are any doubt whatsoever, you should either contact us before placing your order or take appropriate professional advice.

    3. If you supplied us with your email address when entering your payment details we will notify you by email as soon as possible to confirm that we have received your order. We will also send you a confirmation email once the goods have been dispatched.

    4. All products that you order through the Website will remain the property of GSG until we have received payment in full from you for those products.

    5. During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory, must be completed. Please note that we will collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.

    6. All card payments are subject to authorisation by your card issuer and we take payment when we accept your order. If your payment is not received and you have already received the products you ordered from us, you must pay for the products or return those products to us in accordance with reasonable return instructions that we provide to you and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

    7. If we cannot supply you with the product or service you ordered, we will not process your order, inform you of this in writing (including e-mail) and, if you have already paid for the product or service, refund you in full as soon as reasonably possible.

11. Terms of Sale – Delivery Charges

    1. Delivery charges and timescales vary depending on the type of products ordered and the delivery address.

    2. Delivery will be to the UK or international address or store specified in your order. If no one is available at a residential or other address at the time of delivery, a note will be left to advise whether your order has been left in a safe place eg. with a neighbour, or returned to depot.

    3. All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

    4. We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

    5. In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and other applicable legislation. Similar rights may apply for some international deliveries. For further information about your legal rights contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau for UK customers).

    6. Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our products may not be available for delivery to certain destinations outside the UK. GSG reserves the right to define what can and cannot be delivered to which destination.

    7. Payment - Purchases will be made in pounds Sterling. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay.

    8. Products are sold on a delivery duty unpaid basis. The recipient may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for international delivery.

    9. Occasionally, the supply of your product(s) or service(s) may be delayed or prevented for reasons beyond our control – for example, material shortages, import delays or higher than anticipated demand. Where this is the case, we will, of course, make every effort to keep you informed but shall be under no liability to you for such delay or failure.

12. Terms of Sale - Your Right To Cancel

    1. If you are a UK/EU consumer, you have the legal right, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within fourteen working days following your receipt of the goods or the date on which we begin provision of the services. Refunds for orders cancelled under the provisions of the Consumer Contracts Regulations 2013 will be processed in accordance with your legal rights. For further information about your statutory rights, contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau if you are in the UK).

       1. Inform us of your decision to cancel the contract by email to gasstationguitars@gmail.com. This must be sent to us before the end of the 14 day cancellation period.

       2. Send the products back to the address provided to you by GSG upon receipt of the cancellation email.

       3. You must do this no later than 14 days after you notified us of the cancellation. Please note that weekends, bank holidays and public holidays are counted when you calculate the 14 days. Also note that if you cancel the contract, you will have to pay the cost of returning the relevant products to us. 

       4. We are not obliged to give you a refund until we receive the products back from you or we receive evidence from you that you have sent them back to us. We strongly recommend you send the products using a secure or trackable method - i.e. Recorded/Special Delivery - and that you retain your proof of postage.

    2. If you wish to cancel (or are considering cancelling) a product or service you have ordered from us, please be aware of the following terms that apply: 

    3. Applicability of cancellation rights: Legal rights of cancellation under the Distance Selling Regulations available for UK or EU consumers do not apply to certain products and services (for example, made to measure orders, flowers, plants, food, gifts and personalised items);

    4. Damaged or incorrectly supplied products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by e-mail only) within a reasonable period of time. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.

    5. This is not intended to be a full statement of all your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Full details of your rights under the Distance Selling Regulations are available in the UK from your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.

    6. Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

    7. Collection: For certain, larger products, we may offer to arrange collection on your behalf and, where this is the case, you will be responsible to pay the costs of such collection (which we will notify to you in advance).

    8. If you cancel your order in any of the circumstances set out above save for cancellation under the provisions of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, we will refund any money paid by you after any products, which have been delivered to you, are returned to us. In the case of damaged or incorrectly supplied goods, we may offer you a replacement product. Any refunds given by us will be made to the debit/credit card account provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection, as outlined above.

    9. Where we deliver products to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us (or arrange for us to collect them).

13. Terms of Sale – Liability

    1. There are certain liabilities, which we cannot exclude by law and nothing in these T&Cs limits our liability for personal injury or death caused by our negligence or for fraud.

    2. You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods. For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau. Nothing in these T&Cs will affect these legal rights and, in particular, we will perform our obligations under these T&Cs with reasonable care and skill.

    3. Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for a repair or replacement or, where this is not possible, for a refund.

    4. We are only responsible for losses that are a natural, foreseeable consequence of our breach of these T&Cs. We will not be liable to you if we are prevented or delayed from complying with our obligations under these T&Cs by anything you (or anyone acting on your behalf) does or fails to do or due to events, which are beyond our reasonable control.

    5. You must follow any advice we give you to keep products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied, which is caused by your failure to follow this advice.

    6. In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

14. General

    1. These T&Cs do not designate GSG, you or any other party as the agent, employee, legal representative, partner or joint venture of any party for any purpose whatsoever.

    2. If a provision of these T&Cs is invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

    3. The failure of GSG, you or any other party to exercise any right provided in these T&Cs shall not be deemed a waiver or forfeiture of any such right.

    4. Each party must at its own expense do everything reasonably necessary to give full effect to these T&Cs.

    5. All T&Cs relating to payment, disclaimers, limitations of liability, confidentiality and proprietary right shall survive termination.

    6. This Agreement is governed by the laws of England and Wales and each party submits to the jurisdiction of the courts of England and Wales.
